1. Introduction

By accessing this application, we assume you accept these terms and conditions. Do not continue to use HeartWire if you do not agree to all of the terms and conditions stated on this page.

2. Subscription Service

We offer a subscription service for businesses to create and manage a profile on our platform. The service is billed on a monthly basis at a rate of $9.99 USD per month.

• Billing: Subscriptions are billed in advance on a monthly basis and are non-refundable for the subscription period they are purchased for.
• Cancellation: You may cancel your subscription at any time. The cancellation will take effect at the end of your current billing cycle. You will continue to have access to your profile until the end of the billing period.
• Payment: All payments are handled through a secure third-party payment processor. We do not store your credit card details.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

4. Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service.

HeartWire reserves the right to decline, remove, or refuse to display any Content that it deems unfit for public display, at its sole discretion and without prior notice.

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

6. Limitation Of Liability

To the fullest extent permitted by applicable law, HeartWire, its directors, officers, employees, partners, agents, suppliers, contractors, and affiliates shall not be liable for any damages of any kind arising out of or in connection with your use of, or inability to use, the Service. This limitation applies to all claims, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not HeartWire has been informed of the possibility of such damage.

Without limiting the foregoing, HeartWire expressly disclaims liability for:

• Accuracy of Venue Information: HeartWire does not verify, guarantee, or warrant the accuracy, completeness, or timeliness of any venue information, including but not limited to pot sizes, game schedules, game locations, entry fees, or event details posted by venue operators. Players who travel to a venue based on information found on HeartWire do so entirely at their own risk.
• Cancelled or Changed Events: HeartWire is not responsible if a Queen of Hearts game is cancelled, postponed, modified, or otherwise different from what is listed on the platform. Venues are solely responsible for keeping their information current.
• Third-Party Conduct: HeartWire is not liable for the actions, omissions, or conduct of any venue, player, or third party encountered through or in connection with the Service, including but not limited to disputes between venues and patrons, misrepresentation by venue operators, or unsafe conditions at any listed location.
• Financial Losses: HeartWire bears no responsibility for any financial losses incurred by users, including losses resulting from participation in Queen of Hearts games, travel expenses, entry fees paid, or reliance on any information displayed on the platform.
• Data Loss or Service Interruptions: HeartWire is not liable for any loss of data, service outages, system failures, or interruptions in access to the platform, regardless of cause.
• Unauthorized Access: HeartWire is not liable for any unauthorized access to or alteration of your account, data, or transmissions.
• Gambling or Legal Compliance: Queen of Hearts games may be subject to local, state, or federal laws and regulations. HeartWire makes no representations about the legality of any game listed on the platform and is not responsible for any legal consequences arising from a user's participation in such games. Users are solely responsible for ensuring their participation complies with all applicable laws in their jurisdiction.

In no event shall HeartWire's total cumulative liability to you for any and all claims relating to the Service exceed the greater of (a) the total amount you paid to HeartWire in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights. However, HeartWire's liability shall be limited to the greatest extent permitted by applicable law.

7. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
